1. Acceptance of Terms

By accessing or using NomaPhone (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

NomaPhone is operated by NomaPhone (“Company,” “we,” “us,” or “our”).

2. Description of Service

NomaPhone is a browser-based international calling service that allows users to:

  • Make voice calls to landline and mobile numbers worldwide
  • Send and receive SMS messages
  • Purchase and manage virtual phone numbers
  • Access team calling features

3. Eligibility

You must be at least 18 years old to use NomaPhone. By using the Service, you represent that you are of legal age to form a binding contract.

4. Account Registration

4.1 Account Creation

  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities under your account

4.2 Account Security

  • Notify us immediately of any unauthorized use of your account
  • We are not liable for losses caused by unauthorized use of your account

5. Acceptable Use

You agree NOT to use NomaPhone to:

  • Violate any laws or regulations
  • Make emergency calls (911, 112, 999, or equivalent)
  • Send spam, unsolicited marketing, or robocalls
  • Engage in fraudulent activity or illegal telemarketing
  • Harass, threaten, or abuse others
  • Impersonate any person or entity
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to our systems

6. Pricing and Payment

6.1 Credits

  • NomaPhone operates on a prepaid credit system
  • Credits are purchased in packages ($10, $25, $50, $100)
  • Credits never expire
  • Credits are non-refundable except as required by law

6.2 Calling Rates

  • Rates vary by destination country
  • Current rates are displayed before each call
  • Rates are subject to change with 30 days’ notice

6.3 Payment Processing

  • Payments are processed securely through Stripe
  • You authorize us to charge your payment method for all purchases
  • Failed payments may result in service suspension

6.4 Virtual Numbers

  • Virtual numbers are billed monthly
  • Charges occur on the date of purchase each month
  • You may cancel virtual numbers at any time

7. Service Quality and Limitations

7.1 Service Availability

  • We strive for high availability but do not guarantee uninterrupted service
  • We are not liable for service interruptions or quality issues beyond our control

7.2 Call Quality

  • Quality depends on your internet connection
  • We recommend minimum 1 Mbps upload/download speed
  • We are not responsible for poor quality due to your internet connection

7.3 Emergency Services

  • NomaPhone does NOT support emergency calls (911, 112, 999)
  • Use your mobile carrier for emergency services
  • We are not liable for inability to reach emergency services

7.4 Geographic Restrictions

  • Some countries may block VoIP services
  • We cannot guarantee service availability in all locations

8. Refund Policy

8.1 Credit Refunds

  • Credits are generally non-refundable
  • Refunds may be granted at our discretion for:
    • Service outages affecting call quality
    • Billing errors
    • Technical issues preventing service use

8.2 Refund Requests

  • Contact support@nomaphone.com within 14 days
  • Provide call details and description of issue
  • We will investigate and respond within 5 business days

9. Intellectual Property

9.1 Ownership

  • NomaPhone and all related content, features, and functionality are owned by us
  • You may not copy, modify, distribute, or reverse engineer our Service

9.2 License

  • We grant you a limited, non-exclusive, non-transferable license to use the Service
  • This license terminates if you violate these Terms

10. Privacy

Your use of NomaPhone is subject to our Privacy Policy, which is incorporated into these Terms by reference.

11. Termination

11.1 By You

  • You may terminate your account at any time
  • Unused credits remain in your account (they never expire)

11.2 By Us

  • We may suspend or terminate your account for:
    • Violation of these Terms
    • Fraudulent or illegal activity
    • Non-payment
    • Abuse of the Service

11.3 Effect of Termination

  • Your access to the Service will cease
  • Unused credits may be forfeited if account is terminated for violations

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, special, or consequential damages
  • Our total liability shall not exceed the amount you paid in the 12 months prior to the claim
  • We are not liable for inability to make emergency calls

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

15. Dispute Resolution

15.1 Governing Law

  • These Terms are governed by the laws of Italy
  • Disputes shall be resolved in the courts of Naples, Italy

15.2 Arbitration

  • Any disputes may be resolved through binding arbitration
  • You waive the right to participate in class actions

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Email notification
  • Notice on our website
  • In-app notification

Continued use of the Service after changes constitutes acceptance of the new Terms.

17. General Provisions

17.1 Entire Agreement

These Terms constitute the entire agreement between you and NomaPhone.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

17.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver.

17.4 Assignment

We may assign our rights and obligations. You may not assign without our consent.
